1 THE PARTIES
The Owner of Aupres De L'eglise ('The Owner")
The Guest/s ('The Guest/s")
2 ACCEPTANCE OF TERMS UPON SIGNING BOOKING FORM
2.1 The Terms of Rental comprise part of the Booking
Form and upon submitting / signing the Booking Form the Guest and
the Owner mutually agree to be bound by these terms.
2.2 The parties acknowledge that they have read the
Terms of Rent carefully prior to submitting / signing the Booking
Form.
3 ACCOMMODATION AT AUPRES DE L'EGLISE
3.1 The Villa is let fully furnished and equipped,
including crockery, cutlery, bed and bath linen. Fuel for lighting,
cooking, refrigeration, heating and hot water is all inclusive in
the rent during the high season, with a surcharge (to be advised
on the website) being added during the low season. Bath and bed
linen is laundered once a week and in addition facilities are provided
to launder these items by the guests if required during the stay.
3.2 The description contained in the owners brochure
and website have been made in good faith and with proper care. When
changes arise, they will be communicated by amendments to the brochure,
website and verbally as necessary.
4 MINIMUM PERIOD OF RENT AND ARRIVAL TIME
4.1 Unless otherwise agreed in writing the minimum
period of rent is one week starting and finishing on a Saturday.
4.2 The rental starts at 5.00 p.m. on the first day
and ends at 10.00a.m. on the last day of your stay at Aupres De
L'eglise. These times are to be strictly adhered to, to allow enough
time for the Villa to be prepared for the next guests.
4.3 Arrival is required between 5.00p.m. 8.00p.m.
In the event that the guests are to arrive outside this time prior
arrangements must be made with the owner to ensure access on the
day of arrival.
5 PRICES
5.1 All prices are quoted and are required to be paid
in Euros, net of any bank charges.
5.2 The rental charges that have been agreed by both parties will be confirmed on an
invoice forwarded by email or post.
5.3 The method of payment for the deposit and the balance of the booking shall be
(i) by electronic transfer to owners bank account

(ii) by payment by foreign currency cheques are only accepted by
prior arrangement with the owner
(iii) direct credit into Foreign Currency Account
details are on the invoice.
5.4 All bookings are effective only upon the clearance
of funds to the credit of the Owners Bank account.
6 BOOKINGS
6.1 Upon a booking being made a Confirmation Invoice
will be issued. Any booking will be held open for 14 days from the
date of the Confirmation Invoice being sent. In the event that the
deposit is not paid and cleared within 14 days of the date of issue
of the Confirmation Invoice, time being of the essence, the owners
may forthwith cancel the booking and allocate it to another party.
In this event neither party shall have any right or claim against
the other.
7 PAYMENT OF DEPOSIT AND BALANCE OF AMOUNT DUE
7.1 The availability of the Villa will be confirmed
by email or in writing by the owners.
7.2 Within 14 days from the date of the issue of the Booking Confirmation
Invoice, a deposit of 30% of the total amount due, must be received
and cleared through the owners Bank account.
7.3
(i)The balance of the total amount due, is payable in the same manner
as the deposit and cleared through the owners Bank account at least
eight weeks prior to the commencement date of the guests stay at
Aupres De L'eglise.
(ii)The bond of €300 shall also be paid at the time that the final
invoice is due and shall cover any damage done to the propertyduring
the guests occupation of the house. At the commencement of the stay
the guests will be met and shown around the property and given any
instructions/information to ensure that the stay is enjoyable. Upon
departure the house will be inspected and the bond will be refunded
in full by cheque in the event that no damage has occurred.
7.4 Any bookings made within eight weeks of the commencement of
the guests stay must be accompanied by payment of the total amount
due.
7.5 In the event that the balance required is not paid eight weeks
prior to commencement, time being of the essence, the owner shall
retain the deposit, cancel the booking and immediately reallocate
it to an alternative guest.
7.6 In this event neither party shall have any right or claim whatsoever
against the other.
8 ALTERATION TO YOUR BOOKING
8.1 If after booking, and more than eight weeks prior
to the start of the guests holiday, the guest wishes to change the
dates of the holiday, an amendment fee of €40.00 will be charged,
provided that the owner is able to satisfy the request. The owner
shall not be under any obligation to fulfil any alteration requested.
8.2 If a cancellation is recieved more than ten weeks
prior to the booking date the deposit will be refunded with the
sum of €100 being retained to cover administration costs and bank
fees incurred from transactions involved in refunding the deposit.
9 NUMBER OF PERSONS
9.1 The maximum number of persons to be accommodated is ten. The accommodation comprises 8 people in 4 double rooms and an additional 2 more children can be accommodated on foldaway beds or in cots in the parents bedrooms. This number may not be exceeded in any circumstances except with prior arrangement with the owner. All party members names and ages of children must be listed on the booking form at time of confirming booking.
10 INSURANCE
10.1 Guests are required to arrange their own insurance
in respect of their own property, health and safety.
11 BREAKDOWN OF EQUIPMENT
11.1 In the event of any breakdown of mechanical equipment
such as pumps, boilers and all items within the control of the owners,
the owners will make every reasonable endeavour to rectify such
a fault as soon as possible to limit the inconvenience to the guests.
The owners shall not be responsible for any matters beyond their
control.
12 TIDINESS AND CLEANLINESS
12.1 The Villa will be clean and in good order on
arrival and shall be left in a similar state upon departure.
13 BREAKAGE AND DAMAGE
13.1 It is the guests responsibility to leave Aupres
de l'eglise with all its furniture and effects in the same condition
as upon arrival. Guests shall inform the owner of any damage to
the accommodation or its contents and pay for any damaged or missing
items or any extra cleaning made necessary by the Villa being left
in a dirty condition.
14 ANIMALS/PETS
14.1 In the interests of hygiene guests cannot bring
animals to the Villa. Guide dogs, however are permitted.
15 NOISE
15.1 This Villa is in a quiet peaceful countryside.
The guests shall ensure that their use of the Villa does not cause
any nuisance or disturbance to other people in the locality.
16 CANCELLATION
16.1 After the payment of the deposit and or the balance
of the amount due, circumstances arise beyond the control of the
owner that results in Aupres De L'eglise being unavailable at any
time, the owners shall immediately advise the guests and refund
in full all monies paid without deduction The owner will however
use its best endeavours to fulfil all bookings at all times.
16.2 In this event of the owner having to cancel neither
party shall have any right or claim whatsoever against the other.
17. VARIATION
17.1 The parties may agree to vary this agreement
at any time, provided that such variation is recorded in writing.
